— Definitions —

  • Removal Defense

    Those who are in immigration proceedings are never required to obtain legal representation. However they are strongly encouraged to do so. Representing clients in these proceedings requires appearing before Immigration Court/s and appealing to the BIA (Board of Immigration Appeals) if necessary.

  • Asylum

    Asylum is a protection granted to individuals escaping persecution. It allows them to seek refuge in the U.S. if they can prove a credible fear of harm and qualify under a protected class.

  • Daca: Deferred Action for Childhood Arrivals

    DACA is a U.S. immigration policy that provides temporary relief from deportation and work authorization for eligible undocumented individuals brought to the country as children.

  • Family petition

    Family petitions involve a U.S. Citizen or Legal Permanent Resident sponsoring their immediate relatives to immigrate/obtain legal status. The petitioner confirms their relation to the beneficiary, facilitating their immigration process.

  • U Visa: U nonimmigrant status

    The U visa is a nonimmigrant status for crime victims cooperating with law enforcement. It provides temporary status and work authorization to aid investigations and prosecutions. Obtaining this status oftentimes leads to a pathway to legal permanent residence.

  • VAWA: Violence against women's act

    VAWA is a legal framework that allows victims of domestic violence (men or women) at the hands of their immediate family member (U.S. Citizen or Legal Permanent Resident) to obtain a pathway to legal status. It provides work authorization once approved.

  • Sijs: Special Immigrant Juvenile Status

    SIJS is a U.S. immigration classification for minors who have been abandoned, neglected, or abused by one or both parents. Obtaining this status opens a pathway to legal permanent residence and also provides work authorization.

  • Waivers

    Many undocumented individuals may at some point in their immigration process need to file a waiver. There are many types of waivers for all sorts of cases, please consult with an Immigration Lawyer to determine whether one is required for your specific case.

  • Adjustment of Status

    AOS or Adjustment of Status, is generally the last step to obtain legal permanent residency, at least within the United States. The approval of AOS results in a Legal Permanent Resident Card (Green Card) being produced.

  • Naturalization

    Naturalization is the process through which eligible non-native individuals become U.S. citizens. It involves meeting residency requirements and taking the Oath of Allegiance. Exams are typically administered.

  • FOIA: Freedom of Information Act

    FOIA is a U.S. law that grants individuals to request records from the Executive Branch of government. This includes the DHS and DOJ, under which exists the FBI, CBP, OBIM, USCIS, ICE, and many more.

  • Consular processes

    Consular processes involve visa applications at a foreign embassy or consulate. Applicants undergo interviews, background checks, and document reviews to determine eligibility for entry into the U.S.

  • Temporary Importation permit to mexico

    A Temporary Importation Permit for Mexico allows the temporary entry of a vehicle, facilitating its stay in the country for a specified period.
